The Republic under the Constitution and Bill of Rights
How did this happen and why does it matter?
Our forefathers created the Republic for the united States of America as a united group of free states joined together in union under the Constitution and the Bill of Rights, preserving the sovereignty of the people. In the 1860's the Southern States abandoned Congress, which created the absence of a quorum to continue conducting the Constitutional government.
After the Civil War the Constitutional government was not restored. The “federal government” then became a registered corporation and not the Constitutional government that our forefathers founded. The original Republic for the united States of America was usurped by this separate and different UNITED STATES CORPORATION (Title 28 USC 3002 (15)(a)) formed in 1871, which while being an actual corporation, masquerades as our current government.
The Constitution of the UNITED STATES CORPORATION bypasses the original Constitution for the united States of America, which explains why the corporate Congressmen and Senators in Washington, DC don’t abide by the organic Constitution, and the President (a corporate CEO) can write Executive Orders to do whatever he/she wants. They are following corporate rules that completely strip We the People of our God-given, unalienable rights.
The original Constitutional government, however, was never removed, it had simply remained dormant since the 1860's. This fact was made clear by Supreme Court Justice Marshall Harlan (Downes v. Bidwell, 182, U.S. 244 1901) in the following dissenting opinion:
"Two national governments exist; one to be maintained under the Constitution, with all its restriction; the other to be maintained by Congress outside and independently of that Instrument."
What are the differences between the Republic and the CORPORATION?
The Republic for the united States of America
Under the Original Constitution and Ten Bill of Rights
- Individuals are sovereign and have been endowed with certain unalienable Rights by birth, which cannot be abridged except through consent.
- The Republic truly is of, by, and for the People.
- A Representative form of Republic government was enacted, which operates under rule of law and protects the minority from the majority.
- Common/Private Law (i.e. God’s Law) and the system of de jure Grand Juries of peers, is used by sovereigns to settle disputes. Ruling is by laws and sovereigns are only held lawfully liable for personal injury to another person and/or incurred property damage. Contracts must be entered into knowingly, voluntarily, and intentionally.
- A Republic form of government has been enacted.
- Land ownership is reserved for sovereign individuals and transferred by allodial title from one sovereign citizen to another with all mineral an property rights intact.
- Taxation is restricted to products bought and sold and tariffs on goods from outside the country and is used for running the Republic. There is no personal income tax, estate tax, property tax, or any fees or fines against the sovereign individual.
- Money is coined only by Congress, which is controlled by We the People. Historically, currency was backed by gold and silver.
The UNITED STATES CORPORATION
Under the CORPORATION Constitution
- Individuals have lost their sovereignty and become Citizens/Subjects, i.e. corporate fictitious entities, through contractual "obligations" most people have unwittingly agreed to.
- The "Federal Government" (i.e. CORPORATION), while legally only controlling the District of Columbia and its territories, has arbitrarily assumed control over the 50 States.
- A Democracy was established which equates to “mob rule" and favors the majority at the cost of the minority.
- Corporate/Commercial/Contract/Public Law, including Maritime, Admiralty, and International Law is used to deal with criminal acts. Under the Uniform Commercial Code, Admiralty Law, which is practiced in most courtrooms, contracts are not required to be entered into knowingly. Citizens/subjects are therefore obligated to follow, and are held legally liable for rules, regulations, and statutes regarding "agreements" from which they receive benefit. They are subject to penalties, fines and/or imprisonment for breach of said " contracts," whether or not there is an injured party.
- Citizens/subjects do not own property, but are tenants on their own land.
- Personal income tax is collected by a private and separate corporation called the Internal Revenue Service. This tax is used to pay the interest on the national debt. Fees and fines are levied to finance the operation of the individual corporations (i.e. defacto “governments").
- Fiat currency, with no backing, is created and controlled by a private corporation called the Federal Reserve, which is owned and operated by international bankers.
What are we to do?
Excerpts from the Declaration of Independence:
"...That whenever any form of government becomes destructive of these ends, it is the right of the people to alter or to abolish it, and to institute new government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to affect their safety and happiness."
"...But when a long train of abuses and usurpations, pursuing invariably the same object evinces a design to reduce them under absolute despotism, it is their right, it is their duty, to throw off such government, and to provide new guards for their future security..."
Restored Republic!
The Republic for the united States of America and the de jure institutions of the original Constitutional governments of the 50 free states of the Republic were restored when notices were delivered to all 50 corporate State Governors on March 30, 2010, and when the 2nd Continental Congress was convened in Utah and the Declaration of Sovereign Intent re-establishing the original Constitutional government was signed on November 14, 2010 by Congressional representatives from a quorum of 34 States of the Union. The Restored Republic:
Its Continuing Process and Purpose
The Republic for the united States of America (the Republic) has peacefully re-inhabited the Constitutional Republic abandoned in the 1860's. We the People are lawfully reconstructing the de jure institutions of government without controversy, violence, or civil war
The purpose of the Republic is to accomplish the following:
- Re-establish and maintain the Constitutional government and de jure institutions of lawful government abandoned in the 1860's.
- Restore the inherent and unalienable rights bestowed on We the People by the original Republic for the united States of America Constitution.
- End unlawful taxation and prosecutions for resisting the transfer of private wealth to organizations such as the IRS (a registered corporation in Puerto Rico that operates in over 200 countries).
- End all prosecutions which lack an injured party.
- Restore property rights such as allodial title, which makes you a landowner, and not a tenant on your own land.
- End the foreclosure nightmare.
About Us
We the People of Fremont County, Idaho, have come together to form the official Assembly for Fremont County Idaho for the re-inhabited Republic State of Idaho. Our process to become de jure ("de jure" emphasizes a legal basis or right, meaning something is valid and legitimate according to the law) will soon be complete and we will then focus on spreading the word to other citizens of our county and state. We have local county meetings and are working with other counties within the State of Idaho to establish the Republic.
